Rule 48
Procedure for awarding tender ballot
(1) If a voter wants to claim that someone else has taken the ballot paper or voted in his name but he is the real voter, he can claim that he is the real voter by attaching proof of his identity to the polling officer.
(2) In the case where a claim is made according to sub-rule (1), the polling officer shall ascertain whether he is a genuine voter as claimed by the claimant. If the claimant presents his/her citizenship certificate, voter's ID card or other evidence revealing his/her identity, the polling officer shall take a copy thereof.
(3) If the polling officer is convinced that the claimant is a genuine voter from the evidence presented in accordance with sub-rule (2), the polling officer shall record the matter and make a decision.
(4) After making a decision according to sub-rule (3), the polling officer shall prepare the envelope of the tender ballot paper and make the signature of the claimant on that envelope, and write "tender ballot paper" in the blank space to the left of the place to be corrected by the polling officer on the ballot paper and allow the voter who claims the ballot paper to cast his vote.
(5) The ballot paper as per sub-rule (4) shall be kept in a separate envelope containing tender ballot paper inside the ballot box and such envelope shall be kept under the custody of the polling officer.
(6) The polling officer shall keep a separate record of the details of the claimant, the details of the evidence of the claimant and the decision.
